The Federal High Court sitting in Akure, Ondo State, has ruled that Governor Lucky Aiyedatiwa cannot contest the 2028 governorship election, stating that doing so would exceed the constitutional limit for tenure in office.
In the judgment delivered by Justice Toyin Bolaji Adegoke, the court held that the 1999 Constitution does not permit an elected president, vice president, governor, or deputy governor to serve more than eight years in office cumulatively.
Aiyedatiwa assumed office on December 27, 2023, following the death of former Governor Oluwarotimi Akeredolu, completing the remainder of the late governor’s tenure.
He later won the November 16, 2024 governorship election and was sworn in on February 24, 2025 for his own term.

The court ruled that seeking another term after the current tenure would exceed the constitutional limit.
The decision is expected to be challenged on appeal as legal and political debates continue over tenure calculations in Nigeria’s executive offices.
